These Terms of Service ("Terms") govern your use of the website www.epescode.com and services provided by ECode ("Company", "we", "our", or "us"). By accessing this website or using our services, you agree to these Terms.

1. Services

ECode provides digital marketing, website development, automation, software, consulting, and related services. Services may include:

Website design and development
Search engine optimization (SEO)
Advertising management (Google Ads, Meta Ads)
Social media marketing
Marketing automation tools
SaaS platforms (ECode FX, ECode Pro)
Consulting and strategy services

2. No Guarantee of Results

Marketing results may vary based on market conditions, competition, budget, client cooperation, and other factors outside our control. ECode does not guarantee specific lead volume, sales increases, search rankings, or revenue outcomes.

All services are provided on a best-efforts basis using proven strategies and professional expertise. Past results for other clients do not guarantee the same results for your business.

3. Client Responsibilities

Clients agree to provide accurate business information, provide timely access to necessary accounts and platforms, approve content and deliverables within reasonable timeframes, and comply with all applicable advertising platform policies.

Delays in client response, approval, or access may impact timelines and results. ECode is not responsible for performance impacts caused by client delays or failure to comply with platform requirements.

4. Payments

Payments for services may be required in advance unless otherwise agreed in a separate service agreement. Failure to make timely payment may result in suspension of services, removal of system access, or termination of the service agreement.

Ad spend for platforms such as Google Ads or Meta Ads is billed separately from ECode management fees and is subject to the billing policies of those platforms.

5. Intellectual Property

Client content: Clients retain ownership of their business content, branding, and creative assets provided to ECode for use in campaigns and projects.

ECode property: ECode retains ownership of its proprietary systems, templates, frameworks, automation processes, software platforms, and methodologies developed prior to or independent of any client engagement.

6. Third Party Platforms

Services may involve third-party platforms including Google Ads, Meta Ads, CRM systems, hosting providers, and analytics tools. ECode is not responsible for outages, policy changes, account suspensions, or other actions by third-party platforms.

Clients are responsible for complying with the terms of service of all platforms used in connection with ECode services. Account suspensions resulting from client policy violations are not ECode's responsibility.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ECode shall not be liable for lost profits, lost leads, advertising platform issues, website downtime, third-party platform suspensions, or any indirect, incidental, special, or consequential damages.

ECode's total liability for any claim arising from these Terms or the services shall not exceed the total fees paid by the client in the three months preceding the claim. Use of services is at your own risk.

8. Termination

By ECode: We may suspend or terminate services for nonpayment, abuse, violation of these Terms, or unlawful activity, with or without notice depending on severity.

By Client: Clients may terminate services in accordance with the terms of their service agreement. Notice requirements and refund policies are specified in individual service agreements.

9. Website Use

Users of www.epescode.com agree not to:

Attempt unauthorized access to any website systems or accounts
Copy, reproduce, or redistribute website content without permission
Interfere with website functionality or server operations
Use the website for unlawful purposes or to transmit harmful content

10. Changes to These Terms

We may update these Terms at any time. Continued use of our website or services after updates constitutes acceptance. The date of the most recent update appears at the top of this page.
